PoSH Act: Empower Women to Speak Up About Their Grievances without Fear

Sexual harassment at the workplace is regarded as a violation of women's right to equality, life and liberty. It establishes a contentious and insecure work environment, which hinders women's participation in jobs. Therefore, it adversely affects their economic and social empowerment and the objective of comprehensive growth. 


Looking further into this issue that has been deteriorating the capabilities of women the legislative came up with a strong law. The Indian legislature formulated the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013.


Touching, asking for a sexual favour, grabbing, displaying offensive material and offensive comments come under Sexual harassment. 


Under this Act, a person working in the company is required to abide by the laws under the India PoSH Act. No case of sexual abuse shall be left unexplored and justice shall prevail. The accused needs to be questioned by The ICC (Internal Complaints Committee). 


Training for Sexual Harassment Act


Building safety and a culture of responsibility at the workplace is necessary. Circumstances Under Which the Incidence Comes Under Sexual Harassment 


The India PoSH Act provides the situations under which an act may result in sexual harassment. These are:


(i) Implied or explicit agreement of preferential treatment in her employment


(ii) Implied or explicit danger of damaging treatment in her employment


(iii) Implied or explicit risk about her current or future job status


(iv) Interference with her job or developing an intimidating or hostile work


(v) Humiliating treatment possible to influence her health or security.
